Agreement to Terms

These Terms of Service govern your use of Prosody, an iOS application for conversation practice, operated by Lucas Whittle ("we," "us," or "our"). By downloading or using Prosody, you agree to be bound by these terms.

If you do not agree to these terms, please do not use Prosody.

Eligibility

Prosody is intended for users aged 13 and older. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that you have permission from a parent or guardian to use the service.

Your Account

You may sign in to Prosody using Google Sign-In or Apple Sign In. You are responsible for maintaining the security of your account and for any activity that occurs under it.

You agree to provide accurate information when creating your account. You may not use another person's account without permission.

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

Prosody is designed for personal conversation practice. You agree to use it only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse-engineer, decompile, or extract the source code of the app
• Use the service to generate harmful, threatening, or illegal content
• Attempt to interfere with, disrupt, or overload the service or its servers
• Use automated means to access or interact with the service
• Impersonate any person or entity in your account profile
• Use the app for any purpose other than personal practice

Subscriptions and Billing

Prosody offers subscription plans that unlock additional features. Subscriptions are purchased through Apple's App Store and managed by RevenueCat.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account is charged at confirmation of purchase
• You can manage or cancel subscriptions in your Apple ID Account Settings
• No refunds are issued for partial subscription periods, except as required by applicable law

All billing disputes should be directed to Apple, as they manage all payment processing for App Store purchases.

Intellectual Property

Prosody, including its name, design, scenarios, AI characters, and all related content, is owned by Lucas Whittle. Nothing in these Terms grants you any ownership rights to Prosody or its content.

You retain ownership of any content you create or provide while using the service, but you grant us a limited license to use that content to provide and improve the service.

AI Characters and Content

Prosody's AI characters are fictional and designed for practice purposes only. Responses generated by AI characters do not reflect the views or opinions of Lucas Whittle or Prosody.

Conversation practice sessions are generated in real time. We do not guarantee specific outcomes, improvements in communication skills, or particular AI responses. The quality of AI responses may vary.

Limitation of Liability

Prosody is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Prosody, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of Prosody shall not exceed the amount you paid for the service in the 12 months preceding the claim.

Termination

You may stop using Prosody at any time by deleting the app. You may also request account deletion through the app Settings or by contacting us.

We may suspend or terminate your access to Prosody if you violate these Terms, or for any other reason at our discretion with or without notice.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by updating the date at the top of this page. Continued use of Prosody after changes take effect constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Lucas Whittle operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Prosody shall be resolved through good-faith negotiation, or if necessary, in the appropriate courts of that jurisdiction.
